安大略省跨国文件认证变化

《海牙认证公约》又称《加注公约》(英文为:Hague Apostille Convention)于2024年1月11日正式在加拿大生效了。这项多边条约旨在简化跨境公共文件的认证流程, 对加拿大的文件认证服务带来了显著变化。加拿大华人终于告别复杂繁冗的多阶段领事认证程序 (俗称“三级公证”)。

以安大略省为例,符合认证资格的以下文件,若文件的使用目的地同为《加注公约》缔约国,比如中国,则无需公证即可到安大略省具有加注权限的机关进行认证,更无需领事认证:

  1. 出生证明。
  2. 安大略省商业登记处签发的企业登记文件(1991年以后颁发的登记文件)。
  3. 安大略省高等法院或安大略法院在过去 22 年内发布的法院文件。
  4. 自 2019 年 1 月 1 日起颁发的安大略省公立高等教育学位、文凭和成绩单。

重点:以上文件无需公证,亦无需领事认证。

此外,由安大略省公证人出具的公证文件也可以直接在安大略省具有加注权限的机关进行认证,而无需领事认证。

其中,除英语和法语以外的其他语言的文件,比如中文撰写的授权委托书,必须:

  • 在加拿大境内出具文件;
  • 由安大略省公证人公证; 并且
  • 附有加拿大认证翻译员出具的翻译件。

重点:公证文件亦无需领事认证。

现金工工伤索赔的法律保护

在工伤索赔案件的日常法律咨询中最常见,也最困扰当事人的法律问题是:现金工的工伤申报和索赔。不管是工伤受害者还是雇主,他们共同的疑惑是:没有购买工伤保险,事故发生后是否可以向WSIB索赔? 本文将依据安省工伤赔偿法律制度来解答这个问题。

现金工,顾名思义,即雇主没有将该员工纳入payroll ,没有为该员工支付工伤保险费用,也没有为劳动者抵扣income tax,购买CPP和EI。不论是员工自己主动要求还是被动接受现金支付的工作方式, “现金工” 对雇主和员工都不是明智的选择。然而在现实生活中,工伤风险和工资水平越高、人员流动性越大的行业,比如建筑行业,往往采取“现金工”这种方式的情况越多。一旦工伤意外发生,员工和雇主的心理压力都是巨大的。

在此,笔者要明确地告诉工伤受害者,不管雇主是否为员工购买工伤保险,劳动者都有权利去申报工伤。阅读过笔者之前介绍的《安省劳工保险制度简介》的读者应该了解, 安省工伤保险索赔制度是基于无过错原则,即不论工伤事故的发生是否有工人本人,第三方(如同事),抑或是雇主的过错/过失,工伤受害者均可以向工伤主管机构WSIB申报工伤索赔,主要是为了让受伤的劳动者在事故发生后尽快获得相应的医疗帮助和经济支持。安省工伤保险制度不仅保护工伤受害者本人,也为已故工人的家属提供经济赔偿和其他服务。在这种情况下,家属亦可以向工伤主管机构申报。

根据工伤法律规定,认定工伤根据以下五大要素。首先,受害者是一名劳动者, 不管这名劳动者是现金工,季节工,兼职还是全职,或者是学徒工,还是正在做co-op的学生。其次,受伤的时候你正在受雇于一位雇主,而且雇主一般情况下不是你自己本人(特殊情况除外)。法律对“雇主”做了不同意义上的分类, 比如应强制购买工伤保险和可选择性购买工伤保险的雇主(风险小的行业,如会计师事务所和法律事务所),1类雇主和2类雇主(如政府机构,Canada Post等)。在安省,大部分行业都属于需要强制购买的1类雇主。此外,工伤认定还需要证明事故的发生,受到身体伤害的证明,以及二者的因果联系。这三个方面是工伤认定中最重要的,也是最容易产生争议导致工伤申请被拒绝的地方,尤其是对于没有明显意外事故发生的工伤索赔案子,比如由重复性劳动引起的肌肉/关节受损的工伤或者延迟报告雇主的工伤事故。所以工伤发生后,一定要及时报告雇主,及时就医并留下证据。

根据法律规定,现金工只要能证明以上五大要素即可获得工伤认定。若打现金工的工人不幸因工伤逝世,也不影响家属申请WSIB的赔偿和相关服务的权利。WSIB会要求已故工人家属和雇主提交相应证明文件,并根据法律的相关规定,做出决定。

若工伤申请获得认定,现金工的工伤受害者可以获取医疗福利(如理疗康复训练,专家团队会诊治疗),工资损失补偿,永久伤残定级和赔偿,以及就业服务等等。如工人不幸身亡,其家属可以申请的经济赔偿和服务包括:丧葬和交通费用,一次性经济赔偿,定期(按月)支付的经济补偿,遗孀的再就业服务,和家属的心理咨询服务等。

那么,如何确定现金工的工资损失补偿金额?按照法律规定,一般情况下,若因工伤不能返工期间的工资补偿为该员工受伤前的平均净工资收入(net average earning)的85%。若误工超过3个月,补偿的工资基数重新计算,一般为受伤前1-2 年的平均工资净收入。对于有一个或者多个子女的已故工人的现任配偶的定期(每月)经济补偿亦为已故工人受伤前平均净收入 (NAE) 的 85% (无子女配偶,有子女前配偶,现任配偶无子女而前任配偶有子女等情况均有相应具体规定)。

法律的规定大框架看起来似乎清晰明了,但运用到具体情况时错综复杂,且很多规定都有例外情况,笔者无法在此一一详述。每一项工伤福利和服务都有相应的具体要求,申请者务必仔细研读WSIB的政策。现金工涉及的税法问题不在本次讨论范围,请咨询税务专业人士。

If you miss the deadline, you may lose your right to appeal. Submit the Intent to Object Form, which is available on the WSIB website, as soon as possible to formally notify the WSIB of your appeal.

3. Gather Key Evidence

Supporting your case with solid evidence is crucial. Collect updated medical reports, professional healthcare opinions, witness statements, or additional documents that were not submitted in the initial claim. Ensure these documents address the issues raised in the WSIB decision.

Avoiding Common Mistakes When Filing a WSIB Claim for Workplace Injuries

Many workers suffer from workplace injuries but delay seeking medical attention, thinking the issue will heal on its own. One common statement I hear from my clients is, “I wanted to tough it out because I thought my injury would heal by itself over time, so I didn’t seek any medical care or report it to my employer or the Workplace Safety and Insurance Board (WSIB).”

Unfortunately, when symptoms worsen, they often realize it’s too late to claim WSIB benefits. Even if they eventually report the injury, the WSIB may deny the claim due to the delay.

WSIB’s Five-Point Check System for Workplace Injury Claims

To be granted WSIB benefits, your claim must meet five key elements under the WSIB’s Five-Point Check System:

  1. Worker – The individual must be recognized as a worker.
  2. Employer – The employer must fall under WSIB’s jurisdiction.
  3. Work-Related Injury – The injury must be connected to work activities.
  4. Proof of Accident – There must be evidence that the accident occurred.
  5. Compatibility of Diagnosis – The medical diagnosis must be consistent with the accident or disablement history.

When assessing a claim, the WSIB will examine whether there are any discrepancies between the date of the accident, the date the worker stopped working, and the date medical care was sought. Most importantly, the WSIB will look for a clear causal link between the injury or diagnosis and the workplace accident.

Straightforward Claims vs. Delayed Reports

In many cases, workplace injury claims are straightforward. For example, if you slip on a wet floor at work, twist your ankle, and immediately report the accident to your employer, your claim is likely to be processed smoothly. Your employer files a WSIB Form 7, or your doctor submits a Form 8, and the claim can be approved promptly.

However, a delay in reporting can complicate the situation. Let’s say you slip, feel discomfort but continue working for another week without reporting it. Over time, the injury worsens, and by the time you seek medical attention, doubts may arise as to whether the injury happened at work or elsewhere—such as during non-work activities like going to the gym. This delay can lead to your claim being denied by the WSIB.

How to Protect Your WSIB Claim

To avoid claim denials due to delays, follow these three essential steps:

  1. Report the Injury Immediately
    Notify your employer as soon as a workplace injury occurs, even if it seems minor. Under WSIB rules, employers are required to report any workplace injury within three days of being informed, except for minor injuries that only require first aid treatment, or they may face penalties.
  2. Seek Medical Attention Promptly
    If you experience any symptoms, consult a doctor as soon as possible. Make sure to provide detailed information about how, when, and where the injury occurred. Keep copies of all documentation related to your medical visits.
  3. Consult a Legal Professional

安省公证人Notary Public的执业范围

根据安省相关规定,自2020年8月1日起,法律顾问(Licensed Paralegal)经申请,并经省总检察长批准任命,即可成为安省持牌公证人。Mia Liu 现已正式获聘成为安省公证人Notary Public。

公证人可以办理哪些业务呢?

根据公证法Notary Act第三条的规定,公证人可以行使以下职能:

  1. 见证或证明文件签字的真实性 (witness or certify, and attest, the execution of a document);

有些文件必须在公证人的见证下签署方能生效。要获得这类公证,您必须在公证人在场的情况下签署文件。公证人需要验证签字人的身份证件以确保您是文件上要求的签字人。

  1. 认证文件副本与原件相符 (certify and attest a true copy of a document);

认证文件副本与原件相符是经指经公证人验证的文档副本(复印件)为原始文档的真实副本。认证的真实副本的常见类型有身份证明的副本,例如出生证,护照和驾照。公证人会仔细比较原始文件和副本。这意味着您必须向公证人出示原始文件, 而不是原始文件的照片或扫描件。但是公证人并不对文件原件的真实性负责。

  1. 记录和见证宣誓书 (taking affidavits and administering oaths);

宣誓书affidavits可用于多种目的,最常见的用于提交法院证明特定信息的真实性,这样证人就不必出庭。宣誓书在其他的法律程序中或者法庭以外也有广泛的用途,比如在房地产规划事务和家庭法事务中。没有经过宣誓的文书可能会被认为无效。公证人或者宣誓专员 (Commissioner of Oaths)的职责是帮助宣誓人记录证词并见证文件签字, 但并不对宣誓内容的真实性负责。

安省劳工保险制度简介

安省的劳工保险制度建立于1915年,迄今已超过100年的历史,是一套相对完善的制度。在制度建立之前,工人工作时受伤,他们只能通过诉讼来获得赔偿。经济能力薄弱的工人由于请不起律师代理,在诉讼中居于弱势地位,因此经常得不到相应的赔偿。由于当时的工业生产发展迅速,工伤事故频发,然而诉讼程序复杂,耗时费力,雇主也疲于应诉。工伤保险的缺失对社会工业生产发展,雇主和工人都造成了极大的影响。劳工保险赔偿制度就在这样的背景下诞生了。最早提出这个制度的是安省的大法官Sir. William Meridith,因此这个制度也叫Meredith Principle

安省劳工保险制度可以从以下五个方面来理解。第一,无过错原则。不管工伤的发生是由雇员的过失还是雇主的过错导致,均不影响工作安全保险委员会Workplace Safety and Insurance Board(WSIB) 对工伤的认定和赔偿。比如,如果建筑工人没有按照雇主的要求佩戴安全设备因而受伤,这本是雇员的过错导致的,但是这不影响该工人的工伤认定和赔偿。如果采用过错原则,那势必会延误对工伤的认定和治疗,增加雇员索赔的难度。

第二,保险费完全由雇主承担原则。安省整个劳工保险赔偿的经费来源于雇主缴纳的保险费。雇员无须缴纳任何费用,雇主也不能私下让雇员分担,否则违法。

第三,雇主集体责任原则。依照法律规定必须购买工伤保险的雇主缴纳的保险费汇集起来形成一个资金池。用于工伤的赔偿及福利的支出均来自于这里,这就相当于工伤赔偿的费用就由所有雇主共同分担了。

第四,放弃起诉原则,前面我们说了工伤保险制度采用无过错原则,不论是谁的过错,只要经认定为工伤就可以获得及时的补偿/赔偿,免去了诉讼的麻烦。作为代价,受伤雇员也失去了起诉雇主的权利。

第五,专属管辖原则,安省工作安全保险委员会(WSIB)对所有工伤案件有专属管辖权。所有的工伤申报均应向WSIB提出,由WSIB做出决定。WSIB也决定着雇主的保险费率,管理着所有保险费的收集和赔偿费用的发放。同时,WSIB也有强制执行的权利。如果雇员或者雇主有违法行为,WSIB有权做出处罚决定。在工伤保险制度中还有一个非常重要的机构: Workplace Safety and Insurance Appeals Tribunal,简称WSIAT,是一个专门审理工伤案件上诉的行政法庭。 WSIAT上诉法庭的裁决为终审决定。

总的来说, 安省劳工保险制度避免了高昂的诉讼成本,对促进安省产业发展,保护雇员权益发挥了重要作用。
